TELE-MARKETING CONTRACT AND ORDER.

LEGALLY BINDING CONTRACT AND AGREEMENT BETWEEN:

(1) SUPPLIER: and (2) CLIENT.

(1) SUPPLIER: Product: Telemarketing for Your Business.

(1)  SUPPLIER: Trading as: Renato Ditomo ABN 34 379 228 569. PO Box 1556, Bathurst Post Shop, 230 Howick Street, Bathurst, NSW, 2795.

Contract is for: Telemarketing for Your Business.

If we use the expression "our" or "us" or "we" it will be referring to Renato Ditomo.

(2) CLIENT: You are identifying yourself and paying via PayPal. Your identification will be transmitted to us.

Legal Terms and Conditions.

The Client will pay the total quoted and agreed price. We require this amount to be paid, before any work commences to go ahead with the Telemarketing for Your Business. Tax Invoice will be supplied.

The Client may require that we will use a telephone number owned by the Client. This can be achieved by using a SIM CARD and we can make the phone calls, using a mobile number owned by the Client. In this case, the Client agrees to provide a SIM CARD for this purpose. It would need to be connected. via the TELSTRA network. Alternatively, a reseller using the TELSTRA network is acceptable. Ex: Woolworths offer Mobile Plans and they use TELSTRA as their provider. Costs for the SIM CARD would be paid by the Client. A recommended plan is for National Number and National Landlines.

Cost Reduction. We dont normally call 13 or 1300 numbers, and the if Client wants us to call them as well, we can. Simply let us know. If agreed, we will call those numbers.

In some cases, payment can be made after the work has been completed. You will be advised, and agreement can be reached and an Email or Discussion can confirm it. This condition may apply, if it was arranged offline, or via Email.

We will complete the campaign within 60 days or as arranged with the Client.

If we receive all of the documentation, or details about the Clients business after the 60 day period, then the final price may increase. This increase will be at our discretion and the Client will be informed. It is agreed that we should not be compelled to stick to the original price if 60 days is reached, without completion. The Client agrees to pay increased costs determined by Renato Ditomo.

Should the Client cancel the Telemarketing for Your Business, then we will Tax Invoice the Client for any work completed. The Client must advise us by telephone or in writing or Email of the request not to proceed or complete the Telemarketing for Your Business.

Refund requests for any reason. It is agreed that any money paid is non-refundable.

Cancellations: Same as Refund requests above. The Client may cancel, but agrees to a No Refund.

Payment options include Credit Card, Cheque, Direct Deposit, PayPal, Cash. A Tax Invoice is issued in all cases.

We reserve the right to decide if we wish to promote a business. All Clients are viewed on a case by case basis.

Client is required to ensure that their business meets all the current Australian legislation. The Client shall further indemnify Renato Ditomo in respect of any claims, costs and expenses. In other words, Renato Ditomo will not promote any sort of illegal business, or if it becomes illegal after the Telemarketing for Your Business has been completed.

Renato Ditomo reserves the right not to include any material supplied by the Client if we deem it inappropriate or offensive, or if the material appears to infringe on the copyrights owned by other persons / person or company or any organisation. 

Supply of above mentioned material by the Client shall be regarded as a guarantee by the Client that all such permission and authorities have been obtained.

No responsibility will be accepted by Renato Ditomo for damages to or losses incurred by the Client from the use of material for which the required permission or authority has not been obtained. The Client agrees to indemnify Renato Ditomo against all legal claims should any be made, concerning any material supplied by the Client and advertised by Renato Ditomo.

It is agreed that once the Telemarketing for Your Business is completed, and paid for in full, that the Client may change the Telemarketing for Your Business, or engage the services of another Telemarketer to make future adjustments and alterations, or further telephone marketing telephone calls. All such future changes and adjustments are at the sole risk of the Client and Renato Ditomo is no longer responsible for anything, its contents, or the actions of anyone else that is taking over the responsibility.

It is agreed that the Client will not attempt to make any claims or legal claims against Renato Ditomo for any failings or delivery problems supplied by any 3^rd party supplier.

The Client recognises that 3^rd party suppliers may include Domain Name Registration services, or Web Hosting services or any other hardware or software supplier. The Client recognises that Renato Ditomo are not the legal owners of these services, and that we simply use them, and the Client also users these services under the terms offered by the 3^rd party supplier.

It is agreed that the Telemarketing for Your Business Completion Date will be determined by Renato Ditomo. When the Telemarketing for Your Business has been completed, then we will advise Client. The balance will be paid within 7 days if any.

If the Client requires a Major Change to Telemarketing for Your Business, AFTER the payment, and if the Major Changes exceed the quote and agreed price, then the Client will be offered a quote for the additional work. The Client may accept the quote or go ahead with the original work.

The notices for these Major Changes will be notified in writing, Email or Phone as the need arises. The Client agrees to send an Email to Renato Ditomo and confirm agreement to pay for the extra work. If the extra work is of a substantial nature, then Client agrees to sign a Contract or additional agreement to pay for the work.

It is agreed that if Renato Ditomo provides a Telemarketing for Your Business traffic promotion program (either paid or unpaid) that such advertising is NOT guaranteed to provide any sale, or business request, or service request, or even one phone call, from a potential customer. It is agreed that Advertising is risky, including the Internet, and telephone marketing. Renato Ditomo recommends that Internet Advertising or Telephone Marketing be done only after research and the risk is accepted by the Client.

It is agreed that the Client will not ever take action against Renato Ditomo for loss of business. It is understood that there are many variables to a failure including the Clients Business, the Clients reputation, the pricing offered by the Client, the Products offered by the Client, Advertising or lack of Advertising, and even the nature of the people being spoken to on the telephone. It is understood and agreed that the variables of these kinds of failure are beyond the control of Renato Ditomo. The Client agrees to accept all the risks.

The Client understands and agrees that the Do Not Call Register allows telemarketing calls only between these hours and the days listed on the ACMA website. It is agreed that Renato Ditomo will operate under the laws in place by the ACMA. Renato Ditomo will use the ACMA system to wash all numbers prior to the calls.
